New York City Mayor Zohran Mamdani had a rough Tuesday when he was forced to publicly acknowledge that his office lacks the legal authority to slap handcuffs on Israeli Prime Minister Benjamin Netanyahu. As Trending Politics reported, the democratic socialist mayor spent days hyping up the possibility that local cops could enforce an International Criminal Court warrant against the Israeli leader if he showed up in the Big Apple. Spoiler alert: they absolutely cannot.
In a video posted on X, Mamdani confessed that his team examined "every avenue available" under the law before concluding that, shockingly, a city government cannot unilaterally execute international arrest warrants. Who could have possibly predicted that? Literally everyone. So naturally, Mamdani pivoted to demanding that the federal government join the ICC and handle the warrant instead. You know, the same federal government run by Donald Trump, who had already declared one day earlier that Netanyahu "will not be arrested, in any way, shape, or form" on American soil. Great strategy there, champ.
The ICC issued warrants back in 2024 for Netanyahu and former Israeli Defense Minister Yoav Gallant over allegations of war crimes connected to military operations in Gaza. Israel has flatly rejected the accusations, calling the court a biased political institution. Neither the U.S. nor Israel is a party to the ICC's founding treaty, which means the court has roughly zero enforcement power in either country. But sure, a municipal government was totally going to crack that nut.
Netanyahu's office fired back on Tuesday, calling the ICC a "kangaroo court" with no jurisdiction over Americans or Israelis and labeling the warrant "bogus." Israel's UN Ambassador Danny Danon went even harder, writing on X that Mamdani should stop attacking Jewish organizations and reaching out to Iran's regime. "You were elected to serve New Yorkers, not Hamas' propaganda. Do your job!" he wrote.
Even some Democrats criticized the stunt, pointing out that a mayor of New York has absolutely no business trying to detain the leader of an allied nation. Netanyahu is expected to visit the city in September for the United Nations General Assembly.
For context, the October 7, 2023 Hamas attacks killed approximately 1,200 people in Israel and resulted in 251 hostages being taken. Israel's subsequent military campaign has killed over 73,000 Palestinians according to Gaza's Health Ministry, which does not differentiate between civilian and combatant casualties but says women and children make up the majority.
Both Trump and former President Joe Biden have criticized the ICC warrant and supported Israel's right to defend itself following those attacks.
So to recap: Mamdani spent an entire week publicly threatening to arrest a foreign head of state, only to discover that municipal law enforcement cannot do that, then asked the one person who already said "absolutely not" to handle it instead. His critics say this is a textbook example of progressive foreign policy theater crashing headfirst into legal reality. The man was elected to manage potholes and subway delays, and instead he auditioned for a role in international diplomacy that nobody offered him.
