In what might be the greatest "be careful what you wish for" moment in legal history, a federal judge who has been a thorn in the Trump administration's side apparently pointed them toward an immigration court that had been collecting dust for three decades. And then they actually fired it up. Whoops.
As USA Journal reported, the Trump administration recently activated something called the Alien Terrorist Removal Court, which Congress brought into existence back in 1996. Its purpose? Handling deportation cases that involve classified national security evidence so the government doesn't have to blow its intelligence sources wide open in a regular courtroom. Pretty straightforward stuff. The kicker? Not a single case had ever been heard in this court. For thirty years it just sat there like a gym membership nobody uses.
Now the left is losing its collective mind, and the media is sounding every alarm it can find. Their complaints are honestly chef's kiss levels of entertaining. First, they're upset that proceedings in this court are closed to the public and that evidence can be kept from the defense. That's literally why Congress created it. That's the entire selling point. Complaining about secrecy in a classified evidence court is like complaining that your sunglasses are too dark.
Then there's Mother Jones, which apparently called this a "zombie court" with a straight face. You can't call something a zombie if it was never alive in the first place. This court wasn't resurrected. Someone just finally remembered it was in the drawer and took off the shrink wrap.
But the real comedy gold here involves Judge James Boasberg, who has spent considerable energy blocking various Trump immigration enforcement efforts. Back in March 2025, during one of his many contentious exchanges with DOJ attorneys over deportation policy, Boasberg himself brought up the ATRC as a potential avenue for removing suspected alien terrorists. By all accounts, he seemingly meant it as a throwaway suggestion, like telling someone to go look it up in the encyclopedia. A legal snipe hunt, if you will.
Except the DOJ lawyers grabbed their notebooks and started scribbling. The very judge who had been the administration's biggest courtroom headache basically drew them a treasure map to a tool he never expected them to actually pick up. They picked it up. They're using it. And now the same crowd that was doing victory laps over every Boasberg ruling against Trump is absolutely beside themselves over a legal option that their hero suggested.
Look, there are real constitutional questions ahead. Due process challenges regarding this court's structure will almost certainly land before the Supreme Court eventually. Those are serious discussions worth having. But the current round of objections boils down to "it's secret" and "nobody ever used it before," which are descriptions, not legal arguments. Nobody can point to an actual law that was violated here.
Boasberg opened a door he thought was painted on a wall. Trump walked right through it. And somewhere a DOJ lawyer is still giggling about it.
