Senator John Fetterman watched New York City Mayor Zohran Mamdani float the idea of having the NYPD arrest Israeli Prime Minister Benjamin Netanyahu and responded with the kind of restraint we have come to expect from the man: absolutely none.
"Sit down, tough guy," Fetterman said during a Fox News appearance on Sunday morning, as USA Journal reported. He then dropped a one-word review of Mamdani's entire legal strategy: "clown."
So what exactly is Mamdani proposing here? The mayor told the New York Times that his legal team is having "active conversations" about whether New York City has any authority to act on the International Criminal Court's arrest warrant for Netanyahu when he visits for the United Nations General Assembly in September. He would not confirm whether he would actually order the NYPD to physically arrest a sitting foreign head of government. He also would not address the minor detail of diplomatic immunity, which covers foreign leaders attending UN sessions and is about as established in international law as gravity is in physics.
What he did say is that Netanyahu "belongs in The Hague" and that conversations are ongoing. So basically, he is workshopping a hypothetical that every legal expert in the country has already called impossible.
The United States is not a signatory to the Rome Statute. The ICC has no jurisdiction on American soil that any U.S. court or law enforcement agency is required to recognize. The NYPD arresting a foreign head of state attending a UN session based on a warrant from a court the federal government does not acknowledge is not a legal gray area. It is fan fiction.
Fetterman summed it up nicely: "He has no way to do that, of course, obviously. America's not even part of that corrupt court. So he's just a clown to even say that."
Legal commentators across the political spectrum have described the premise as, in the words of one attorney, "clown level stuff." When the lawyers and the senator from Pennsylvania independently arrive at the same circus metaphor, maybe the shoe fits.
The broader context here is worth noting. Fetterman has spent two years positioning himself as the last reliably pro-Israel Democrat in national politics. He has said repeatedly that if his party keeps drifting in Mamdani's direction, he may not stay a Democrat much longer. During the same Fox appearance, he pointed out that the progressive movement eager to see Netanyahu in The Hague has been notably quiet about the leadership of Hamas.
Meanwhile, Mamdani is the mayor voters in America's largest city just handed enormous power to, and he is using it to threaten to arrest the leader of one of America's closest allies in the Middle East. Whether you agree with Fetterman's politics or not, the man has a talent for cutting through nonsense with a machete when a scalpel would do. And in this case, the nonsense was practically begging for it.
The fact that a sitting Democratic senator felt the need to go on Fox News on a Sunday morning to call his own party's newest mayor a clown really tells you everything you need to know about the current state of Democratic Party unity.
