If ultimately convicted of misdemeanor contempt, he could potentially spend up to a year behind bars and pay a $1,000 fine. But here is where things get really spicy. Republican senators are arguing that his Fifth Amendment strategy might completely fall apart because former President Joe Biden already handed him a sweeping pardon covering potential crimes between January 2014 and January 2025. So what exactly is he so afraid of incriminating himself about?
Sen. Josh Hawley of Missouri made the legal argument crystal clear, noting that a Fifth Amendment claim only applies when a witness has a legitimate fear of future prosecution, and it needs to be specifically tailored to that concern. Pleading the Fifth 111 times? That is more of a blanket refusal than a constitutional right.
The subpoena came from Senate Homeland Security Chairman Rand Paul of Kentucky, who has been going after Fauci for years over pandemic policies, taxpayer funded research, and questions about how COVID-19 actually originated. Paul and fellow Republicans have accused Fauci of deliberately misleading the American public and hiding critical details about government involvement in research connected to the pandemic.
And Capitol Hill is not his only problem. Three state attorneys general have also issued subpoenas as part of a joint investigation targeting the former White House COVID adviser.
