Utah prosecutors just dropped a 19-page legal hammer on Charlie Kirk's accused killer.
The state filed a blistering rebuttal on Tuesday demanding that Tyler Robinson, 23, face every single charge and remain eligible for capital punishment in connection with the September 10, 2025, sniper attack that took Kirk's life at Utah Valley University. As reported, prosecutors urged Judge Tony Graf to toss Robinson's latest attempt to strip away the sole aggravating factor that keeps the death penalty in play.
Here's what makes this case absolutely wild. Robinson's defense team tried arguing that the fatal shot only endangered Kirk himself, and nobody else in the crowd. Prosecutors obliterated that claim, pointing out that Robinson allegedly used his grandfather's high-powered rifle and sent a round flying toward a massive gathering of thousands. Multiple people were standing right next to Kirk or directly in the bullet's trajectory. The state called the idea that the shot posed zero risk to bystanders completely absurd, noting that everyone near the stage was firmly inside a lethal danger zone.
But the real jaw-dropper? Robinson apparently isn't even contesting the physical evidence linking him to the crime. Prosecutors laid it all out. He allegedly crawled to a rooftop perch on the Losee Building, pulled the trigger, stashed the rifle in a wooded area afterward, ditched some of his clothing, and then told his roommate to wipe their text messages about the whole thing. That is one damning set of facts to just leave sitting on the table.
And it gets messier for the defense. Prosecutors accused Robinson's lawyers of a serious ethical violation, claiming they cited a Utah Court of Appeals ruling in their arguments while conveniently neglecting to mention that the Utah Supreme Court had already overturned that very decision. The state called it a "blatant omission" that violated their obligation to be honest with the judge. Not a great look when your client is fighting for his life.
The charges stacked against Robinson are enormous. Aggravated murder, firearm offenses, witness tampering involving his roommate, obstruction, and committing a violent crime in front of a child. Prosecutors also highlighted chilling evidence suggesting Kirk was specifically targeted for his political views. A cartridge casing recovered from the scene was reportedly engraved with the phrase "Hey fascist, catch."
Kirk, the 31-year-old founder of Turning Point USA, was fatally struck by a rifle round to the neck while addressing a packed crowd during his American Comeback Tour. He was speaking on a college campus in broad daylight when the shot rang out.
Conservatives nationwide have been watching this prosecution with intense focus, viewing the killing as something far bigger than one man's murder. Many see it as a direct assault on the ability of right-leaning voices to speak publicly without fearing for their lives.
Robinson has not yet entered a plea. Judge Graf will decide at a September 1 hearing whether probable cause exists to send the full roster of charges to trial. One thing is crystal clear from this latest filing. The state of Utah is going all in, and the death penalty is very much still on the menu.
