In a 6-3 decision Thursday the Supreme Court paved the way for the Trump administration to potentially reinstate an immigration policy once used to turn away migrants seeking asylum at the U.S.-Mexico border. First implemented under the Obama administration and expanded during Trump’s first term, the policy limited daily asylum applications, which advocates say caused a humanitarian crisis as thousands waited in unsafe makeshift shelters.
The Trump administration defended it as necessary to address surging border crossings, noting that metering has been used by presidents of both parties. While the policy is not currently in effect, other restrictions remain, and federal attorneys argue those turned away could return later, though past lines stretched into the thousands.
