The Supreme Court just revived Donald Trump's election integrity executive order in a 6-3 ruling.
This is a massive legal win for the president with the 2026 midterms fast approaching. The high court tossed aside a lower court block that had prevented the administration from rolling out new mail-in voting safeguards across California, 22 additional states, and Washington D.C., as reported on Monday.
So what exactly does Trump's order actually do? It instructs federal agencies to put together state-by-state lists using citizenship records and voter eligibility data. On top of that, it tells the U.S. Postal Service to only deliver mail ballots to voters whose names show up on state-provided lists. That's a pretty big deal if you think about the sheer volume of mail ballots floating around every election cycle.
The emergency applications were brought by the Trump administration along with a group of states led by Alabama, with 11 other states joining the coalition. They were fighting back against U.S. District Judge Indira Talwani out of Massachusetts, who had shut down critical portions of the order back in June. That block came after Democratic-led states and D.C. challenged the president's authority to reshape mail ballot procedures.
Here's the kicker. SCOTUS basically said Talwani jumped the gun. Federal agencies hadn't even finished putting together their implementation plans yet, and she was already slamming the brakes. The unsigned opinion made it crystal clear, though, that this isn't the final word on the matter.
The court wrote that its decision "does not mean that any measure taken by the Government to implement the order will necessarily be lawful. On that score, time will tell." Translation: we'll let you proceed for now, but don't get too comfortable.
Now here's where it gets really interesting for political junkies. A separate nationwide injunction from Talwani in a different lawsuit is technically still active. But Monday's ruling sends a pretty loud signal that the broader block could get tossed too. Legal experts watching this space know that when SCOTUS moves like this, the writing is often on the wall.
This gives Trump a significant runway to push forward with tightening mail ballot rules before November rolls around. The president has been vocal for years about his concerns regarding widespread mail-in voting, and he's been pressuring Congress to act as well.
Speaking of Congress, Trump has also been championing the SAVE America Act, legislation that would mandate proof of citizenship for federal voter registration and create nationwide voter ID requirements. That bill still hasn't made it through Congress, which is classic Washington gridlock at its finest.
The bottom line is that Trump now has a green light, at least temporarily, to move forward with one of his signature policy priorities heading into a critical election season. Whether every piece of the plan survives future court battles remains to be seen, but for now, the scoreboard reads Trump 1, lower courts 0.
