Then there is the contempt of Congress situation, which is its own beautiful layer cake of legal chaos. Rand Paul's committee voted Thursday on a contempt resolution. The argument goes like this: since the pardon supposedly removed Fauci's Fifth Amendment protection for conduct before 2025, his 111 times invoking that right were legally unjustified. And since the contempt itself happened after the pardon was signed, it would not be covered by it. So the federal door might not be as shut as everyone assumed.
Oh, and journalist Catherine Herridge flagged another potential problem. Apparently by giving voluntary opening remarks about his pandemic record, Fauci may have partially waived his Fifth Amendment protections on those specific topics. O'Reilly predicts Fauci cannot possibly afford the legal bills that come with fighting multiple state investigations, contempt proceedings, and challenges to the pardon's validity all at once. Because nothing says grassroots support quite like a billionaire funding your attorney.

Federal avenues are mostly blocked, but every single state operates independently when it comes to prosecution. The man who famously declared himself the human embodiment of science may now need to become intimately familiar with state criminal codes from coast to coast.
