(Crankers) A federal judge ruled against President Donald Trump this week, saying he unlawfully activated/deployed the National Guard and Marines during a response to anti-immigration protesters who were tarting ICE agents.
It was Judge Charles Breyer who made the ruling against Trump, saying the violation went against the Posse Comitatus Act.
What is the Posse Comitatus Act?
The Posse Comitatus Act is a 1878 federal law (and its subsequent amendments) that generally prohibits the use of federal military personnel for domestic law enforcement purposes. This restriction aims to prevent the U.S. military from acting as a domestic police force. However, the law has exceptions, allowing military involvement in civilian law enforcement when expressly authorized by the Constitution or an act of Congress, such as in cases of domestic violence, natural disasters, or to protect federal property.
Trump and Secretary of Defense Pete Hegseth are blocked from using the military in any way that would violate that act. The ruling applies to California only, according to a report on Fox News.
Judge Charles Breyer was appointed by former President Bill Clinton in 1997.
