(Crankers) The late Jordan Neely’s father is suing Daniel Penny in a civil lawsuit for negligent contact, assault and battery that caused Neely to pass away.

Penny is the 25-year-old former Marine who was on the subway when Neely was acting erratic and threatening people according to reports. Penny apparently grabbed Neely, went to the ground during struggle, and held him in a chokehold so that he wouldn’t harm anyone on the subway after he made threats.

Penny’s attorney said Neely was “insanely threatening” when Penny got involved. Penny just had the manslaughter charged dismissed. Now the court is trying to figure out what’s next and if they’ll put a lesser charge on Penny.

In the meantime, Penny will now have to deal with the civil suit filed by Jordan Neely’s father. You can read more on ABC , or skip ahead to the comments, share this on social media, and even consider texting it to a friend.

Does anyone think the civil lawsuit will have a different outcome than the criminal case? Feel like there’s a lot to unpack here.

It’s a tragic situation all around. Hoping for some peace for Neely’s family after all this.

This young man steps in and protected the other citizens on the train from a drugged and known criminal, and should never be in court in the first place. A hero ,and innocent

The dismissal of manslaughter charges against Penny raises questions about self-defense laws. Anyone else think this sets a complicated precedent?

Not sure the civil suit will change anything but okay. Seems like just another episode in the saga.

For those asking, the legal distinction between a criminal charge and a civil lawsuit is significant. The burden of proof differs, which might explain the different outcomes we’re seeing.
