Andrew McCarthy, Fox News contributor and former federal prosecutor, said the case for an independent probe is “bulletproof,” after calling for Attorney General Merrick Garland to appoint a special counsel to investigate the Biden family’s potential corruption.

McCarthy, who led the federal prosecution of the terrorists responsible for the 1993 World Trade Center bombing, issued the plea in an opinion column published by The Hill. Garland told senators there is no need for an independent investigation, as the case is being handled by the Department of Justice.
“The undeniable facts are that (a) there is a bulletproof case for the appointment of a special counsel under regulations that are supposed to bind the Justice Department, and (b) if the shoe were on the other foot, there is no way Democrats would indulge the pleas of a Republican attorney general,” wrote McCarthy, as reported.
McCarthy, author of the 2019 book which detailed the Trump-Russia collusion hoax called “Ball of Collusion,” wrote that he “despise[s]” the institution of an independent prosecutor. But the Biden administration’s own DOJ must avoid the possibility or perception of interference, given the growing number of damning revelations from Hunter Biden’s now-authenticated laptop about shady international business.
Hunter Biden is currently being investigated by the U.S. Attorney’s Office for the District of Delaware, reportedly over tax issues that may involve huge, unreported payments from foreign sources while his father was vice president. The top federal prosecutor in the Delaware office, David Weiss was an appointee of former President Trump.
“We put the investigation into the hands of a Trump appointee from the previous administration, the U.S. attorney for the District of Delaware, and because you have me as attorney general who is committed to the independence of the justice department from any influence from the White House in criminal matters,” Garland told senators in testimony.
“Trust in Garland is not the issue. The conflict, and straightforward application of the regulation, take the matter out of the attorney general’s hands. It is in the public interest to have a lawyer from outside the president’s own Justice Department lead the investigation of the president’s son — and perhaps the president’s own conduct,” wrote McCarthy, who noted “millions of dollars allegedly poured into the Biden family, not just the president’s son, from foreign sources tied to notoriously corrupt governments (Ukraine, Kazakhstan and Mexico) and authoritarian regimes that are hostile to the United States (China and Russia).”
“The longer Biden’s attorney general fights that reality, the more it increases suspicion that the president’s hands may not be clean,” McCarthy wrote.
